IMPORTANT DOCUMENT RELEASE
The Koh Tao murder case accused ‘s defence team has been working closely with REPRIEVE in the United Kingdom to explore the UK police role in the investigation of the Koh Tao murder case.

I have now been given permission by REPRIEVE, REPRIEVE lawyers and Mr. Nakhon Chompuchat, head lawyer for the Koh Tao case defence team, to release the Metropolitan Police response document publicly.
In summary from this document:
– The UK Metropolitan police did not conduct any investigations into the Koh Tao murders in Thailand, had observer status only and did not provide any advice or assistance;
– The Metropolitan Police did not during its visit to Thailand take possession of any evidence, including physical evidence, forensic evidence, exhibits, interviews or statements;
– The police are preparing a report but this is for internal use only and will not be completed until January 2015 – it will not be shared with the Thai authorities;
– No other information will be shared with the Thai authorities by the UK government or police without an assurance regarding the death penalty;
– The UK police do hold some limited information on the case but rely on an exemption under the Data Protection Act to refuse to provide this information (because it would prejudice a criminal prosecution).
This response leaves some major questions unanswered, including the issue of the validity of statements issued by the UK Foreign and Commonwealth Office on behalf of the parents of the deceased.
For other questions and discussions on this issue/response, the lawyers team welcome public debate that will hopefully result from release of this document in full. CR. ANDY HALL

2/10/2014 Three Myanmar construction workers were arrested by the police, one of them has confessed to the murder of the two British tourists. Pol Gen Jakthip Chichinda, deputy commissioner of the Royal Thai Police who was just appointed to head the investigation team, said one construction worker has confessed to the murder of the British tourists, David Miller and Ms Hannahb Witheridge, 23. But he said the police have yet to send DNA samples from the three Myanmar suspects for testing in Bangkok which will take a few days to confirm if their DNA samples match the DNA collected from the body of the tourist, Ms Hannah. Pol Gen Jakthip did not elaborate if the two others have confessed or have connection on which part of the crime. But earlier the police team found them appearing in surveillance cameras near the scene and almost at the time when the murder took place. Expressing deep concern at this stage with the ongoing public announcements by individuals gaining access to the accused on guilty or innocent status of 2 Koh Tao murder case accused migrants. Voluntary and consensual confidential Thai lawyer and Myanmar accused client relationship now crucial to ensuring the accused can access a fair trial in this publicly debated case. In most normal cases (of which now this clearly is not), trained criminal lawyers would now surely be advising their clients to stay silent. Public suspicion will go on but lawyers need space to work. Guilt/innocence in Koh Tao case will crucially be decided eventually by the courts based on all facts and testimony presented to them and not by police, prosecutors or the general public. Capable and skilled lawyers must now crucially be given time and space to focus on confidential case defense preparation with the accused, having competent and reliable translation assistance at all times, if the accused are to be assured a fair trial. The accused must crucially be supported to make consensual and informed decisions about their lawyers, defence strategy and the nature of public statements made on their case as much as is possible.

Evidences collected from the crime scene that were sent for tests of DNA include three cigarette butts found about 50 metres from where the two British tourists were killed. One cigarette has lipstick mark. DNA of two people were found in the second cigarette and the DNA of a third person was found in the third cigarette butt. However, the tests show that the DNA found in one cigarette butt match with the DNA found in the semen, said the sources. Pol Col Prachum Ruangthong , chief of the Koh Phangan police station, said that the police have freed all the suspected migrant workers and now have to restart investigation from the beginning. He said the police have its goal in mind to restart the investigation which he declined to elaborate. DNA tests are expected to be known tomorrow, Pol Maj Gen Dr Pornchai Sutheerakun, commander of Police General Hospital’s Institute of Forensic Medicine, said today. Dr Pornchai said 24-year-old David Miller died after being hit on his head while water was also found in his lungs. Medical examiners initially believed the victim was thrown into the sea after being hit by the hard object. Bruises were also found on the back of the victim’s hands and on his back, and it is believed that they were caused while attempting to protect himself before he died, he said. Regarding 23-year-old Hannah Witheridge, Dr Pornchai said she was struck hard by a sharp object on her head. Pro-Islamic, Muslims apologist and anti-Myanmar Maung Zarni is insulting Sitagu Sayadaw because the venerable has said that most religions are based on Fear and people are manipulated by aggressive religions. Sayadaw is just advocating for peace.

Sayadaw finally said “ဒါေၾကာင့္ ဒို႕ကေတာ့ ျမတ္ဗုဒၶဆုံးမတဲ့အတိုင္း favour (favoritism) ႏွင့္ fear အစြန္း နွစ္ဘက္က လြတ္ေအာင္ေရွာင္ၿပီး ဒို႔တိုင္းျပည္နဲ႕ ဒို႔လူမ်ိဳးကို ဓမၼဓိဌာန္ က်က် ေစာင့္ေရွာက္ ကာကြယ္ သြားမည္ ျဖစ္ေၾကာင္း ေျပာၾကားလိုပါတယ္္။”

Welcome to Sitagu International Buddhist Academy. I am glad to meet and to discuss with you.
There are six major Religions in the world today. Since Human beings came on Earth, people worshipped the Sun, the Moon and various deities. They also sought refuge in them on the basis of fear. It was called a primitive religion. Most of scholars stated that horror initiated the religions of those days. The Buddha also clearly said that the idea and concept of religions originated from fear. Therefore every religion has full responsibility for the removal of fear which is sticking on the mind of people. But, on the contrary, it is regrettable that a fearful religion and its followers emerged in the world.
After the primitive religions there appeared Hinduism. And afterwards, Jainism also came out on the Land where Hinduism was being flourished. Forty years after the emergence of Jainism, there appeared Buddhism also. Buddhism appeared on the birth place of Hinduism and Jainism and peacefully coexisted with them for ages. There was no traceable history of bloodshed and conflict among them. Also there was no violence and quarrel even on the statement issued by the Hindus saying that the Buddha was an incarnation of God Vishnu. We had only oral and written arguments.ted as slaves when the United States of America was established. In the same way, the English rulers illegally imported labourers from India and Bangladesh to Myanmar for the hard labour during their rule.
Six hundred years after the Buddha, Jesus Christ appeared in the World. In the ten commandments of Christianity we find many similarities with Buddhism in the field of Morality and Noble practice. Christian missions tried to flourish their faith when they came to the East Asian countries such as India, Sri Lanka, Myanmar, Thailand, Korea and Japan. The people of those countries were non-Christians. But, even after the arrival of Christianity also there was peaceful coexistence between Christians and non-Christians. No history of conflict can be traced to any side. Because all the Hindus, Janis and Christians are walking together on the common platform of their respective teachings, that is Morality, Loving-kindness and compassion. The religion, founded based on Loving-kindness and compassion, has no conflict and it does only social welfare services like Health, Education and other social infrastructures.
In Myanmar, many Christians converted to Buddhism in the past as well as at the present. They did it not because they were forced by the Buddhists. Similarly, many of Buddhists also converted to Christian faith. No single Christian threatened them to do so. They did it of their own free will. Every religion has and should have freedom of worship and freedom of belief. Look at the Crusade that prolonged about forty years. It was recorded in the history of the world.
We have to note that the beginning of conflict is aggressiveness and extremism either in the field of religion or that of politics. Today, in Iraq, the Islamic extremists are forcing ancient Zoroastrians to change their faith into Islam. They even threatened them to kill if their demand is not met. In Africa, a Muslim woman was given the death sentence just because she has converted to Christianity. Therefore, we, the East Asian Buddhist countries are living in constant daily fear of falling under the sword of the Islamic extremists. As we are lacking power and influence, we cannot compete against with the rapid growth of Islamic world.
There was a recorded history that in the thirteenth century A.D, a Muslim army marched from Turkey through India and destroyed Pala Buddhist dynasty and converted it into Islamic state. Pala Buddhist dynasty was none other than present Bangladesh. In the south of Philippine, the Islamic extremists revolted against the government for twenty years. Today, they established a Muslim state there. The Islamic extremists are holding weapons in the south of Thailand to make it a separate Muslim state.
Every religion, according to me, should perform its activities only for the good and welfare of the people. But, today, Islamic extremists are trying to establish Islamic states by waging war against non-Muslims. It is regrettable that they are performing the holy war (Jihad) on the name of God. The regional court has struck down a charge against London Sayadaw U Oatara after reviewing his appeal for the unfair charge under Section 295 (a) of the Penal Code.
“The authorities will not invoke Section 295 (a) against the monk. The regional court accepted the appeal and there will be no legal action related to this section in Tarmwe Township Court,” said defence lawyer Nay La.
The charge, seen as a religious offence, was reportedly invoked under the direction of Mahana Phonegyis, government-backed monks of State Sangha Maha Nayaka Committee, the ruling body for Buddhist monks.
Five monks, including the London Sayadaw, are standing trial for religious violations in connection with a monastery property.
London Sayadaw U Oatara said his counter charges against twenty Buddhist monks including Mahana Phonegyis have been rejected by Bahan Township Court on July 16. He said he would find an appeal at district and regional levels.
Four Buddhist monks on trial, U Panyarsar, U Thondarathiri, U Nandiya and U Tayzeinda will reportedly follow the Sayadaw’s lead to remove their charges under Section 295 (A).
