19 jailed for protest against land seizures

A Pobbathiri Township court issued sentences against 19 Nay Pyi Taw residents yesterday for holding a ploughing competition in protest of the government’s seizure of their land to use it for state-run newspapers.
Judge Khin Win sentenced Zaw Lat, the protest leader, to seven years in prison with hard labour, while 18 others will serve prison sentences ranging from four to six years plus hard labour.
“The unilateral verdict is based only on police statements. We were not allowed to call witnesses. We were afforded no rights. It is totally unfair for us to receive long-term sentences,” said Zaw Lat.
In the 2003-4 fiscal year, the information ministry confiscated more than 500 acres of land to build a printing house for state-run newspapers in Webyan village, Zeyathiri Township. Twenty-two farmers received compensations that were far lower than actual land prices in 2009-10, and 38 others were not compensated at all.
The government’s failure to negotiate with the villagers about the seized land led to a protest on September 12, 2013. More than 70 police raided the protest and arrested the villagers, who reportedly defended themselves. The protesters were then charged with several crimes, including disturbances to police duties.

(16 ก.ค.) วานนี้ เมื่อเวลา 17.00 น. ร.ต.ท.อุดม ศรีสงค์ ร้อยเวร สภ.เมืองระยอง รับแจ้งมีเหตุใช้อาวุธปืนยิงตัวตาย เบื้องต้นได้รับบาดเจ็บสาหัส เจ้าหน้าที่มูลนิธิสว่างพรกุศล รีบนำส่งรพ.ระยอง จึงเดินทางมาดูที่โรงพยาบาล ทราบชื่อผู้ได้รับบาดเจ็บชื่อ นายสุทธิ อัชฌาศัย อายุ 49 ปี อดีตผู้ประสานงานเครือข่ายประชาชนภาคตะวันออก แพทย์รีบนำเข้าห้องผ่าตัดเพื่อช่วยชีวิตอย่างสุดความสามารถ เนื่องจากกระสุนปืนทะลุขมับขวาถูกศีรษะ 1 นัด อาการสาหัส

จากการสอบถามนางฉิน อัชฌาศัย อายุ 74 ปี มารดานายสุทธิ กล่าวว่าก่อนเกิดเหตุนายสุทธิลูกชายอยู่ที่บ้านถามแม่ว่ากินข้าวหรือยัง จากนั้นลูกชายก็เดินไปขึ้นรถยนต์กระบะยี่ห้อโตโยต้าสีเขียว ทะเบียน พ 1426 ระยอง ที่จอดอยู่ในโรงรถ ได้ยินเสียงติดเครื่องยนต์ สักครู่ได้ยินเสียงปืนดังขึ้นหลายนัด จึงรีบเดินมาดูพบลูกชายใช้อาวุธปืนยิงตัวตาย ในมือยังกำปืนพกสั้นรีวอลเวอร์ขนาด .38 มม. อยู่ แต่ยังไม่เสียชีวิต จึงรีบแจ้งให้เจ้าหน้าที่มูลนิธิฯรีบนำส่งรพ.ระยอง

ผู้สื่อข่าวได้เดินทางไปดูที่บ้านเกิดเหตุทราบว่านายสุทธิใช้อาวุธปืนยิงใส่กระจกหน้ารถก่อน 3 นัด ก่อนจะใช้ปืนกระบอกเดียวกันจ่อยิงขมับขวาตัวเอง 1 นัดกระสุนทะลุศีรษะ อาการสาหัส ก่อนถูกนำส่งรพ.ระยอง ที่บริเวณโรงรถพบกระจกหน้ารถถูกยิงแตกกระจายกระสุนปืนไปถูกหลังคาโรงรถจำนวน 3 รู สาเหตุการฆ่าตัวตายครั้งนี้น่าจะมาจากความเครียดปัญหาหนี้สิน

ทั้งนี้ นายสุทธิ อัชฌาศัย อดีตผู้ประสานงานเครือข่ายประชาชนภาคตะวันออก เคยนำมวลชนออกมาต่อต้านคัดค้านโรงงานอุตสาหกรรม โรงไฟฟ้าถ่านหิน

ล่าสุด เมื่อช่วงเช้า (16 ก.ค.) มีรายงานว่า นายสุทธิ ได้เสียชีวิตลงแล้วอย่างสงบ ตั้งบำเพ็ญกุศลศพ ณ วัดตรีมิตรประดิษฐาราม ต.บ้านแลง อ.เมือง จ.ระยอง

The National Police Office commissioner today ordered the immediate investigation into yesterday’s fatal shooting of an anti-government protest leader at an advance polling station in Bang Na. A dozen of protesters were also injured.

Heading the investigation team is Police General Aek Angsananont, the deputy commissioner of the National Police Office.

The deputy commissioner immediately called an urgent meeting to expedite the investigation in the shooting in front of  Wat Srieam temple in Bangna which resulted in the death of protest leader Suthin Taratin, the leader and also a founder of the People’s Army to Overthrow the Thaksin Regime yesterday.

He ordered that every measure be taken to gather all the necessary evidence in the case such as interviewing eyewitnesses and bystanders, and also interviewing injured parties who were at the scene and also if possible, to gather any video clips that might have been filmed by persons who were at the scene of the shooting.

Initial investigation of closed-circuit TV footing of the scene reveals that the shooter was travelling on Sri Nakharin road when his path coincided with the victim’s.

The deputy police commissioner also order an investigation into whether there was any dereliction in duty by the local police force who were responsible for the security of the area.

He ordered that all evidence and reports must be completed and handed in within 7 days and denied the allegation that some police personnel had switched shell casings found at the scene.

He stated that he was on-scene immediately after the incident and found no evidence to support the claim. He however stated that should evidence to support the claim surface then the full force of the law will be brought to bear upon the perpetrator.

Mr Suthin’s body has been transported to the Forensic Department at the Ramathibadi Hospital for an autopsy today as requested by his family.

On hand were Doctor Nirand Pithakwatchara from the National Human Rights Commission and  Khunying  Porthip Rojanasunant, a forensic doctor and Investigator with the Justice Department.

But Khunying Pornthip was not in the autopsy team but arrived to observe the autopsy.

Results of the autopsy revealed that the bullets had exited the victim’s body and the trajectory of the bullets was from both sides of the victim. T

The spouse of the deceased, Kanistha Duang-In stated that her husband was an avid politician and has been involved in politics for a long period.

 

 

Suthep charged with making unlawful, impossible proposals

BANGKOK, Dec 10 – Caretaker Justice Minister Chaikasem Nitisiri said today that the resignation of the caretaker government including prime minister Yingluck Shinawatra would be a breach of the Constitution.

Flatly rejecting protest leader Suthep Thaugsuban’s demand for Ms Yingluck to relinquish the caretaker position, he said the caretaker Cabinet members are bound by the royal decree to assume their responsibilities and their resignations would be in violation of the charter.

The stipulation (on a caretaker government) is clearly stated in Section 181 of the Constitution to avoid vacuum in the country’s administration, he explained.

Mr Chaikasem said Mr Suthep’s proposals on an interim government and people’s council were unlawful.

Mr Suthep is not empowered to issue orders to Cabinet members, civil servants and government officials, or set up a volunteer unit to work in place of the police, he said.

He said Mr Suthep is violating the royal power in announcing the formation of a government and Cabinet while the present administration remains in charge.

The caretaker justice minister said the authorities would arrest Mr Suthep on insurrection charges if they could approach him.

Somsak Kiatsuranond, former Parliament president, said Mr Suthep should be realistic and abide by the charter in making political proposals and resolutions for the country.

He called for dialogues to find acceptable frameworks before the general election is held, saying it would be worrisome if the Democrat Party boycotts the upcoming polls. (MCOT online news)

Labour Minister wants Suthep arrested in 48 hours

Caretaker labour minister Chalerm Yubamrung on Tuesday urged Pol Lt-Gen Kamronwit Thoopkrachang, commissioner of metropolitan police, to arrest protest leader Suthep Thuagsuban in 48 hours on insurrection charge.

Chalerm who was assigned by Prime Minister Yingluck Shinawatra to handle the protest problem  asked protesters to pack up and return home saying that the government has already submitted to their demand for House dissolution.

He also pleaded with protesters not to invade into government offices, saying that they are state property.

The labour minister accused Suthep of breaking Article 157 of the Criminal Code for demanding the resignation of all cabinet ministers.

เมื่อวันที่ 3 ธันวาคม สภาทนายความได้ออกแถลงการณ์ เรื่องการปฏิบัติตน และการปฏิบัติหน้าที่ตามคำวินิจฉัยของศาลรัฐธรรมนูญ ดังนี้

ตามที่ปรากฏความชัดเจนแล้วว่ามีคณะบุคคล ข้าราชการทั้งฝ่ายบริหารและฝ่ายนิติบัญญัติ หัวหน้าพรรคการเมืองแสดงออกโดยชัดแจ้งถึงการไม่ยอมรับคำวินิจฉัยของศาลรัฐธรรมนูญนั้น สภาทนายความเห็นว่าเรื่องนี้เป็นเรื่องสำคัญอย่างยิ่งที่จะเผยแพร่ให้สาธารณชนทั่วไปทราบถึงข้อกฎหมายและการบังคับใช้คำวินิจฉัยของศาลรัฐธรรมนูญ ดังนี้

1.ผู้ที่มีหน้าที่และต้องปฏิบัติตามคำวินิจฉัยของศาลรัฐธรรมนูญนั้น มาตรา 216 วรรคห้า ของรัฐธรรมนูญแห่งราชอาณาจักรไทย ได้บัญญัติไว้อย่างชัดเจนว่า “คำวินิจฉัยของศาลรัฐธรรมนูญให้เป็นเด็ดขาด มีผลผูกพันรัฐสภา คณะรัฐมนตรี ศาล และองค์กรอื่นของรัฐ” ความชัดเจนของบทบัญญัตินี้จึงไม่อาจแปลความเป็นอย่างอื่นได้ว่าจะมีองค์กรใด บุคคลหรือคณะบุคคลใดที่จะสามารถปฏิเสธหลักการถ่วงดุลในระบอบประชาธิปไตยตามหลักสากล

2.หลักการถ่วงดุลนี้มีปรากฏตามพระบรมราชปณิธาน ที่ได้พระราชทานรัฐธรรมนูญไว้ มีความตอนหนึ่งอยู่ในวรรคสามว่า “การยึดถือระบอบประชาธิปไตยอันมีพระมหากษัตริย์ทรงเป็นประมุขเป็นวิถีทางในการปกครองประเทศการคุ้มครองสิทธิและเสรีภาพของประชาชน ให้ประชาชนมีบทบาทและมีส่วนร่วมในการปกครองและตรวจสอบการใช้อำนาจรัฐอย่างเป็นรูปธรรม การกำหนดกลไกสถาบันทางการเมืองทั้งฝ่ายนิติบัญญัติและฝ่ายบริหาร ให้มีดุลยภาพและประสิทธิภาพตามวิถีการปกครองแบบรัฐสภา รวมทั้งให้สถาบันศาลและองค์กรอิสระอื่นสามารถปฏิบัติหน้าที่ได้โดยสุจริตเที่ยงธรรม” จึงเป็นการวางหลักการถ่วงดุลอำนาจอธิปไตยทั้ง 3 ทาง ซึ่งพระมหากษัตริย์จะทรงใช้พระราชอำนาจตามรัฐธรรมนูญ

After examining the evidence, the Court this afternoon issued an arrest warrant for the MP-turned protest leader.After seizing the Finance Ministry, Mr. Suthep announced his plans to mobilize demonstrators to seize other state offices nationwide, including provincial halls and district offices.The Foreign Ministry was among the state offices visited by the anti-government demonstrators yesterday. Other destinations included several TV stations, the Interior Ministry, the Government Public Relations Department, and the Budget Bureau. Despite the ongoing protests, Prime Minister Yingluck Shinawatra insisted that she would not resign, nor would she dissolve the parliament. — BANGKOK, 26 November 2013 (NNT) – Anti-government demonstrators have seized four key government offices on Tuesday following their occupation of two other ministries the day before.The four ministries currently under siege are the Ministry of Tourism and Sports, the Ministry of Transport, the Ministry of Agriculture and Cooperatives and the Ministry of Interior.Protesters have sealed off entrances to the ministries and allowed government employees to leave after the offices were taken siege. Protest guards are being stationed near the premises’ entrances and exits.Anti-government protest leader Suthep Thaugsuban earlier announced that he would mobilize demonstrators to seize state offices nationwide, including provincial halls and district offices. BANGKOK, 26 November 2013 (NNT) – The Foreign Affairs Ministry has sent letters to the United Nations (UN) and foreign embassies in Thailand, informing them of the current political situation.Foreign Minister Surapong Tovichakchaikul said that letters have been sent to embassies in Thailand, the UN Headquarters in New York, and the 5 members of the UN Security Council which include the United States, China, England, France, and Russia. The letters were meant to explain the current political situation in Thailand, telling them that many government offices have now been seized by the protesters, and the ongoing protests are illegal, while calling on the international community to condemn the action. Foreign Minister Surapong has also ordered his officials to press charges against rioters who destroyed the ministry’s front gate during their storming into the premises. The minister went on to say that 22 embassies in Thailand had already issued warnings to their people, urging them to avoid going near all demonstration sites for their own safety. According to Mr. Surapong, the US embassy has expressed its disagreement to protesters taking over state offices by force, saying the move is not a kind of protest under the democratic system.
