21.january President Thein Sein sent a message to the parliament on January 20 requesting that parliament reconsider the National Education Law following demands from students and teachers to reduce centralization of the Myanmar education system and permit the establishment of organisations.
The Union parliament approved the National Education Law on September 30, 2014. Forty-six per cent of the law’s provisions were drawn by the parliament, and remaining 54 per cent were drawn by the Ministry of Education.
In his message to parliament, the president mentioned that there are stakeholders who demand the reduction of centralisation, the elimination of the National Educational Commission, the freedom to form students and teacher associations and the promotion of ethnic minority literature in schools.
The president also said that since the Ministry of Education has not been able to fulfil the demands of these stakeholders and because the law is still not enforced in practice, the legislation should consider amending it. Is this correct?

Myanmar authorities said on Tuesday that they would take legal action against a newspaper for an interview describing the words of the president as “absurd and insane”, amid mounting international concern over backtracking on press freedoms.

The Myanmar Herald Journal, renowned for its criticism of the government and ministers in the former junta-run country, was accused of having “tarnished the image and rights” of President Thein Sein, according to a statement from the information ministry published in state-backed media.

The decision to sue the paper, which authorities said followed a process of mediation by the interim press council, comes as media freedoms fall under the spotlight before a visit by US President Barack Obama next week.

His visit is likely to highlight concerns over journalist arrests and the death in army custody of a freelance reporter late last month.

According to the information ministry, the Myanmar Herald Journal ran an interview in which the subject described the president’s words as “gibberish, irrational, cheap and inconsistent… completely nonsensical, absurd and insane”. The recent radio message of President Thein Sein gave a hint—political dialogues would be in the vain hope unless a nationwide ceasefire deal could be signed. Consequently, if the political dialogues were not able to go ahead (if there had been political instability), it was sure that 2015 elections would be unlikely to be held, I suppose.
In this state, if 2015 elections can’t be held, who will continue administering the country? Many uneasy questions are arising among the people as to whether or not President Thein Sein will continue holding the power. Who to continue administering the country is a problem. It had better assess this problem depending on the 2008 Constitution.
If the 2015 elections can’t be held on the pretext of political instability, President Thein Sein must declare a state of emergency in accord with Section 417 prescribed in the 2008 Constitution after coordinating with the National Defence and Security Council along with the specified duration of one year from the day of promulgation.
After that the President shall declare the transferring of legislative, executive and judicial powers of the Union to the Commander-in-Chief of the Defence Services to enable him to carry out necessary measures to speedily restore its original situation in the Union. In other words, the army does not intentionally need to seize the State’s power, the President will have to transfer it to the Commander-in-Chief of the Defence Services. It shall be deemed that the legislative functions of all parliaments (Hluttaws) and leading bodies shall be suspended from the day of declaration. It shall also be deemed that on the expiry of the term of the said Hluttaws, the relevant Hluttaws have been dissolved automatically in accord with the Section 418 (a).
The significant point is the Section 418 (b). It said that notwithstanding anything contained in the Constitution, commencing from the day of transfer of the sovereign power to the Commander-in-Chief of the Defence Services, it shall be deemed that the members appointed and assigned duties by the approval of the relevant Hluttaws in accord with the Constitution, Self-Administered Division Leading Bodies or the members of Self-Administered Zone Leading Bodies, with the exception of the President and the Vice-Presidents, have been terminated from duty.
In other words, all government members except the President and the Vice-Presidents have been terminated from duty from the day that the President transferred the power to the Commander-in-Chief of the Defence Services.

If the Commander-in-Chief submits the extension of the prescribed duration by giving reasons why has not yet been able to accomplish the duties assigned to him, the President may normally permit two extensions of the prescribed during for a term of six months for each extension, stated in the Section 421 (b). The matter relating to the extension shall be reported to the emergency session of the Pyidaungsu Hluttaw (Union parliament) by summoning it. If the Commander-in-Chief submits the extension of the prescribed duration by giving reasons, he has not been able to accomplish the assigned duties, on the expiry of the term of the Pyidaungsu Hluttaw, the National Defence and Security Council normally permit two extensions of the prescribed duration for a term of six months for each extension.
But, the Constitution does not clearly mention that if the emergency session of the Pyidaungsu Hluttaw is timed to coincide with the relevant Hluttaws that will be dissolved automatically in accord with the Section 418 (a), on the expiry of the term, who shall summon the emergency session of Pyidaungsu Hluttaw.
The Section 422 promulgated that if the Commander-in-Chief submits a report of accomplishing his duties assigned before the expiry of the term of Pyidaungsu Hluttaw, the President shall declare the annulment of the ordinance transferring the sovereign power to the Commander-in-Chief by convening an emergency session of the Pyidaungsu Hluttaw. If the Commander-in-Chief submits it in time of Hluttaw expiry, the President shall declare the annulment of the power vested to him (the Commander-in-Chief of Defence Services) after coordinating with the National Defence and Security Council under Section 418. MYANMAR BURMA Gov’t working to release all prisoners of conscience

EMGYANGON—President Thein Sein is doing his best to honour his pledge to release all prisoners of conscience before the end of the year, Minister for the President’s Office Soe Thein said during a meeting with political parties yesterday.

“We are working for the release of all political prisoners at the end of December, as President Thein Sein has promised to the world. We are holding more than two meetings a week on this, and the working committee is holding daily meetings,” said Soe Thein.

In his keynote speech at London’s Chatham House on July 15, President Thein Sein spoke about the nation-wide ceasefire with armed groups and pledged to release all political prisoners by the end of this year.

The president’s promise is on shaky ground at the moment, however, as there have been more people arrested under Section 18—thus increasing the number of political prisoners, members of the Remaining Political Prisoners Scrutinizing Committee said on Saturday.

Thailand, Myanmar agree on bilateral meeting

BANDAR SERI BEGAWAN, Oct 10 – Thai Prime Minister Yingluck Shinawatra and Myanmar President Thein Sein agreed to a bilateral meeting for further cooperation of both countries.

At a sildeline meeting during the 23rd ASEAN Summit and other related summits on October 9-10 held in Brunei Darussalam, Thai Government Spokesman Teerat Ratanasevi said of the meeting’s result that both countries agreed upon opening their mutual border to increase and develop trade as well as visits among the peoples, particularly at Myawaddy and Tha Chi Lek.
Thailand proposed Myanmar to apply a ‘national single window’ measure to prevent goods smuggling through the borders, causing both countries loss of benefits from tax collection. Thailand is ready to support the technology and provide knowledge to Myanmar in such matters.
Prime Minister Yingluck also asked President Thein Sein to give importance to the Dawei deep-sea port development project, for it is an investment project that will create connectivity within the region. Both leaders agreed that Thailand and Myanmar should search for interested investors from other countries to invest in the project while waiting for other investment decisions.
Mr Teerat said the Thai premier asked the Myanmar president to consider the development of Trilateral Highway which will connect land transportation of three countries — India, Myanmar and Thailand — and that Myanmar agreed with the idea.
Thailand and Myanmar will meet with the Indian prime minister at the next ASEAN+3 meeting to discuss developing such a highway. (MCOT online news)

– The public must have the opportunity to get involve in order to directly benefiting their needs. This is very important. The planning and implementation should be widely accepted by the locals, then it will definitely addressing their needs. It will also reduce the wasting of money on unnecessary projects.

– In order to avoid the disputes later, any projects should be discussed and consulted widely within local community so as to deter any unnecessary problems risen up in the future. e.g Letpatan Taung project

Myanmar Burma President’s 8 point peace guideline quietly shelved

Naypyitaw has quietly withdrawn its controversial 8 point guideline that was publicly laid down in May 2012 as pre-conditions for political dialogue with armed resistance movements, according to Karen and Shan technical teams returning to the border after holding meetings with representatives from government, political parties and civil society organizations last week….

The Comprehensive Union Peace and Ceasefire Agreement, formally presented by the joint Karen-Shan delegation on 17 August to U Aung Min, the government’s chief negotiator, calls for the establishment of a High Level Joint Peace committee (JPC), now renamed Pyidaungsu Peace and Dialogue Committee (PPDC), he added.

The PPDC, comprised of top leadership from the Government/Army, Ethnic Nationalities Armed Groups and Political Parties, “will ensure the legalization and constitutional path of the final Union Accord agreed by the Pyidaungsu Union Conference” mandated by it, according to the proposal.

The two sides are reportedly still deliberating on the first revised draft of the Nationwide Ceasefire Agreement, details of which have yet to be made public. “Suffice it to say that it was based on the proposal that we had submitted,” said a Karen delegate.

According to the planned timeline, the Accord signing ceremony, to be witnessed by world dignitaries including Union Secretary General Ban Ki-Moon, is to be held late October. The “Nationwide” agreement will require at least 8 (out of 16 armed groups, according to government count) to sign it.

So far, only the Karen National Union (KNU) and the RCSS/SSA have agreed “in principle.”
