Military bans media outlets from publishing Kokang group’s statements.
The Military Authoritative Information Team today sent a letter to Myanmar Press Council (Interim) informing that the local news media outlets are not to cover any statements released by Myanmar National Democratic Alliance Army (MNDAA).

The letter carried two points. The first point is that representatives from MNDAA (Kokang rebel group) are reported to have been attending the conference of the leaders of ethnic armed groups being held in Panghsan, Shan State (East). The second point states that as MNDAA is declared an unlawful association by the government, the news media outlets are barred from broadcasting or publishing MNDAA’s statements coming from the conference. The letter warned that any media outlet that fails to follow the instruction will face action in accord with the existing laws.

The warning letter is dated May 8, which falls on World Press Freedom Day. The letter said MNDAA is declared an unlawful organisation. According to the Unlawful Associations Act, anyone who contacts or assists the unlawful associations will face a three-year imprisonment under section 17(1) and a five-year imprisonment under section 17(2).

“From my point of view, there are two parts to consider: the criteria of press freedom and the country’s current situation. This declaration is unreasonable from the perspective of press freedom. It is not in line with the freedom of expression. This is from criteria viewpoint. When this is to be linked with the country’s present situation, Myanmar’s press freedom index is at the bottom of the list because it hasn’t been long that the military regime has shifted into a semi-civilian government. The military still intervenes in the political sphere. The attitude of the military is that this is their ‘Type Organisation’. The battles with the armed group called Kokang are different from those happened with other groups. There are conflicts and they are sensitive. So, I want to say that we need to keep on going cleverly in accord with the condition of the country and the standards of press freedom,” said Kyaw Min Swe, the secretary of the Myanmar Press Council (Interim).

“Other armed ethnic groups including MNDAA have been in attendance at Panghsan’s ethnic conference. If the media expresses the news released from MNDAA, action will be taken. Why is an action taken against other ethnic groups apart from the MNDAA? Taking actions against the media and not taking action against the ethnic groups are not fair. Therefore, the statements and announcements coming from Panghsan ethnic conference should not be recognised and actions should be taken against. It looks to be an indirect way to control the media. 1. On March 27, the Minister of Information Ye Htut wrote on Facebook that he has been blocked from accessing http://www.news-eleven.com, the website of Eleven Media Group.
2. In Myanmar, internet websites cannot block individual users unlike Facebook accounts. In the same way, Eleven Media Group cannot know and does not have the chance to find out which users are using which IP.
3. However, U.S-based Cloudflare Company has been providing technical assistance to the IT Team of Eleven Media Group to find out which IPs have been attacking Eleven Media Group’s website. Therefore, for security reasons, Cloudflare has temporary blocked access of the IPs that have been attacking Eleven Media Group’s website multiple times to prevent them from attacking the website again.
4. Eleven Media Group’s website has faced multiple attacks from those who are part of the propaganda mechanism that wants to protect the welfares of dictators and the website has undergone losses. These attacks are taking place every day. Thus, Eleven Media Group’s website has taken necessary measurements in advance for security reasons.
5. However, it has been learnt from Ye Htut’s Facebook post that he has been using the IP that has been blocked by Eleven Media Group for attacking its website. This IP has been temporary blocked because some people who were using this IP have been violating existing laws and making cyber attacks.
6. Thus, we request the Minister of Information to take action against those violating the law in line with the law.
7. We would like to inform the Minister that we will remove the temporary blocked IP if the Minister would make an official request.

Public Statement
Violation of the rights of the victims and alleged offenders must be stopped:
The performance of the officials and media in Koh Tao murder case
On 15 September 2014, two tourists from UK were murdered and their bodies were left on the beach of Koh Tao, Surathani, Southern Thailand. Later on 2 October 2014, police officials claimed three suspects who are migrant workers from Myanmar have confessed to the charges and on 3 October, two of them were brought to the crime scene for reenactment and an ensuing press conference was widely reported in the media.
Since the investigation is still ongoing, the alleged offenders must enjoy the right to presumed innocence until a final verdict is made against them. It is prohibited to treat them as if they are already the perpetrators. Human Rights Lawyers Association (HRLA) and other signatories would like to express our deepest concern about the practice of the concerned officials and media which would be tantamount to a violation of the right to privacy of the victims’ families and the rights of alleged offenders as follows;
1. In a case where death sentence is mandatory, if an alleged offender does not have his lawyer, it is required that the inquiry official must provide him a legal representative as per Article 134/1 of the Criminal Procedure Code and Article 14 of the International Covenant on Civil and Political Rights (ICCPR). Should the official fail to provide a legal counsel, any evidence given by the alleged offender would not be admissible.
2. If the confession given to the official has been obtained when the alleged offender is put under duress or being threatened, such a statement shall not be admissible. The officials who have committed such an intimidating act will also face a legal action since the act can be construed as a breach of an obligation as per the Convention Against Torture and other Cruel, Inhuman or Degrading Treatment or Punishment (CAT).
3. The reenactment of the crime at the crime scene, even though it was done so as part of the gathering of evidence by the inquiry officials, but it should be carried out solely just to serve the said purpose, but not to be part of a press conference. Even though the case has attracted avid attention from the public, the authorities are required to respect the right to privacy and the right to freedom and dignity of the alleged offenders. In addition, according to the Royal Thai Police order no. 855/2548, it clearly stipulates that no media would be allowed to be present during the enactment of the crime and no interviews or interaction between the inquiry officials and the alleged offenders or other parties can be given or made in the presence of the media, since their reports might have tampered with the investigation.
4. There was a massive and extensive dissemination of images and information about the crime scene reenactment and the interviews with state officials and other persons concerned or not with the case via the media. Several news agencies featured quite graphic images or facts about the event. The redistribution of information and images of the victims by the media simply give reminiscence to the horrible incidence and would only further traumatize families of the victims. It would also infringe on the dignity of the alleged offenders and might tamper with the investigation. Breaches that happened include for example an interview to the press by the interpreter regarding the statements given by the alleged offenders to the officials, even though such revelation was a breach of the code of ethics of an interpreter, or an interview given by a National Human Rights Commissioner who was supposed to be there simply to monitor if any rights violation has taken place or not, but not to give an interview to affirm incriminating evidence against the alleged offenders.
The Human Rights Lawyers Association (HRLA) and other signatories have the following demands to make;
1. Any interviews by persons concerned and not with the case in future must be carried out with consideration of their respective roles and the code of ethics regarding confidentiality which must be observed during the investigation process and dignity and reputation of the victims must be respected.
2. In the reportage by media, caution must be made to ensure respect of the right to privacy and to mitigate any further damage to the reputation of the victims and alleged offenders. It should always be borne in mind that any media report might induce the audience to prejudge a person as a perpetrator. But if it is proven later that that person is not guilty, any remedies would not suffice the damage already done to the person. Media professionals, in particular, are urged to seriously monitor their own work.

The article written by ‪#‎PaulMooney‬ in ‪#‎Reuters‬ is tantamount to political assassination on NLD, Daw Aung San Suu Kyi and her supporters. This is a serious and sensitive matter and he shouldn’t write what NLD hasn’t said officially. I don’t know him personally and I got no personal issues with him. But, there should be ethic in writing reports or news since media plays very influential role shaping public opinions and to flourish democracy. Over 50 journalists who staged a silent protest during President Thein Sein’s visit to the Myanmar Peace Center on Saturday have been charged for protesting without permission, according to senior police sources.
The journalists sat outside the center wearing black tape across their mouths and T-shirts saying: “Stop Killing the Press” as the president was meeting with artists in the morning. They were joined by residents from Michaungkan who have been waging a year-long protest to claim their confiscated lands back.
“All journalists and Michaungkan residents who participated in the protest have been charged with Section 18 [of the Peace Assembly and Procession Law] because they did not apply for permission and held an illegal protest. They will be investigated through photo records. They may be released on bail after they have been arrested,” said a senior police official on condition of anonymity.
The protests came in response to the recent sentencing of four journalists and the chief executive of the now defunct Unity Journal with ten years hard labour for an investigative report on the existence of a secret weapons factory.
The interim press council held a meeting on Saturday and issued a statement condemning the ten-year sentence of the Unity five and requested a meeting with the President. They also forwarded a motion saying they would resign and dissolve the council if their request was not met.
“The press council will request a meeting with the President. International journalist associations and human rights groups have criticised the recent media crackdown saying as a repression of civil liberties and press freedom.
Ei Mon Kyaw, the executive editor of Doe Taung Thu journal, published by People Power Media, heard that she may be one of the ones charged under Section 18 for attending the protest.
“I’m sad after hearing that I’m included among those who have been charged. If I’ve been really charged, I will face the case bravely,” she said.
Others who participated in the protest had not been officially informed yet but were ready to face any charges.
“The police station did not inform me officially, but I’ve learnt from my sources that I’m included in the list of journalists that will be charged. As I’ve done what I should have done, I’m ready to face it,” said Aung Thura, chief reporter of the 7 Day daily newspaper.

Pol Gen Watcharapol Prasarnrajkit, the Deputy National Police Chief and present acting National Police Chief, has been called upon to set up a committee chaired by the national police chief. The members of the committee are largely representatives of the Special Branch Bureau, Office of Information and Communication Technology, and Foreign Affairs Division, and have been specially assigned to investigate alleged inappropriate content in any type of media including online messaging. Anyone possessing, transferring, or sharing such content will be penalized severely. –
