Battles Continue in Kachin and Northern Shan State as Ethnic Armed Groups Prepare for the Next Meeting

A battle took place between Kachin People Militia Northern Shan State (Mungshawa Hpyen Hpung in Kachin) troops under KIA’s 38th Battalion and Burmese army troops under 567th Light Infantry Regiment at Banglum Bum in northern Shan State on Dec 16 at 2:30 pm. No casualties on either side have been reported so far.

Another battle took place on the same day between KIA’s 8th Battalion troops and Burmese army’s 505th Light Infantry Regiment troops at 4 pm. The two sides encountered at a location between Prang Tawng village and Bang Lung village in northern Shan State as Burmese army troops currently stationed at Namlek Bum came down from the mountain.

A series of battles between KIA and Burmese government troops have been reported from sources in northern Shan State and Kachin State.

On Dec 13, KIA’s 9th Battalion troops fought against Burmese army’s 45th Light Infantry Battalion troops at Hu Nawng village in northern Shan State at 8:15 am. A local source said the two sides encountered at Hu Nawng village when Burmese government troops marched towards KIA’s 4th Brigade area from Kut Kai in northern Shan State.

Kachin People Militia (MHH) troops under KIA 2nd Battalion and Burmese army’s 125th Light Infantry Battalion troops battled near Mungsi in northern Shan State on Dec 11 at 11:30 am. KIA sources say the fighting took place as Burmese army troops encroached into Mungji Huyet Bum area where Kachin people militia (MHH) troops have a base.

In Kachin State, Burmese army troops under Bhamo-based 21st Military Operations Command (MOC-21) reportedly fired several rounds of artillery shells on civilians working in their rice field near Mungding Pa on Dec 9 at 12 pm. Most Mungding Pa villagers have already fled their village when government troops fired Mungding Pa and Kawng Ja village with 60 mm artillery shells in mid-October. Only some farmers remained in the area living in the forest close to their rice fields during harvest time. Government troops entered Mungding Pa village after firing several rounds of 60 mm artillery shells, seizing an IDP camp and a middle school. About 600 villagers were trapped inside Mungding Pa for days.

MYANMAR BURMA : Courts fine activists for peace protests, while others face jail

YANGON – Two members of the Kachin Peace Network have been fined Ks 20,000 (US$20) each by courts in Sanchaung and Dagon townships on Tuesday for demonstrating for peace in war-torn Kachin State.   

“Under Section 18, Sanchaung Township Court and Dagon Township Court fined us [the activists] for holding the unauthorised demonstration to end the wars in Kachin State on the International Peace Day,” Maran Jaw Gun from the Kachin Peace Network told Eleven Media yesterday.

Under Section 18 of the Peaceful Assembly and Procession Law, Maran Jaw Gun and May Sabe Phyu were sentenced a one-month imprisonment or allowed to pay a fine of Ks 10,000 (US$10) in the two courts.

“We protested on behalf of the people who are suffering in the refugee camps due to the conflict. Our demand is the demand of the refugees. We also submitted for permission to the authorities and since the authorities didn’t give us permission, we held the demonstration, which is our right as citizens.”

Last Thursday, activists including student leader D Nyein Lin were given a one month prison sentence for protesting against the authorities use of fire bombs against demonstrators in the Letpadaungtaung copper mine project last November. They did not have the option of a fine.

Political activists have criticised Myanmar’s judiciary for giving one month’s prison sentences to the six Letpadaungtaung activists, while the Kachin peace activists were given fines even though they were all charged under the same Section.

“According to the law, [the activists] were accused for protesting without permission. There seems to be distinctions in the judiciary because different courts gave different sentences even though the activists were tried under the same Section. So this may lead to doubts among the public against Myanmar’s judiciary sector,” said Myint Aung, a lawyer from the Assistance Association for Political Prisoners (AAPP).

AAPP member Aung Myo Kyaw said he believes the activists were given different sentences because the government wants to protect the interests of the Chinese company Wenbao, which is jointly operating the copper mine project with military-owned Union of Myanmar Economic Holdings Ltd.

He added that Myanmar’s judiciary sector is infamous for injustice and corruption and the government is still unable to control it.

Maran Jaw Gun and May Sabe Phyu from the Kachin Peace Network have been charged under Section 18 by the courts in six townships – Sanchaung Township, Tamwe Township, Mingala Taungnyunt Township, Pazundaung Township, and Dagon Township – for leading a march of around 1,000 demonstrators calling for peace in the Kachin State on September 21, 2012.

Political activists, legal experts, and social organisations have been demanding the government to amend Section 18 after the six activists were given one month’s imprisonment last week.

Lower House MP Thura Aung Ko have earlier said the Parliament will review the proposal to amend Section 18.

ကခ်င္ျပည္နယ္ ဗန္းေမာ္ခရုိင္ မန္စီျမိဳ႕နယ္ မုန္းဒိန္ပါ (Mungding Pa) ေက်းရြာရွိ အျပစ္မဲ့ ကခ်င္ရြာသား ၇၀၀ ေက်ာ္အား ျမန္မာအစိုးရတပ္သည္ ယမန္ေန႔ ၂၂ ရက္ အဂၤါေန႔မွ စ၍ ကခ်င္ႏွစ္ျခင္းခရစ္ယာန္ေက်ာင္းတြင္ လုံျခဳံေရးခ်ထိမ္းသိမ္းထားေၾကာင္းသိရသည္။

ဆက္လက္ျပီး ယေန႔ နံနက္ထိ အစိုးရတပ္မ်ားလႈပ္ရွားလာျခင္းေၾကာင့္ KIA တပ္ရင္း (၁၂) နယ္ေျမ (ရွမ္းျပည္နယ္ဘက္ျခမ္း) မဘိန္းျမိဳ႕နယ္ ေရႊလီျမစ္အေနာက္ဘက္မွ ဆဂနမ္ခြမ္ (Saga Nam Hkum) တြင္ တိုက္ပြဲျဖစ္ပြာခဲ့ေၾကာင္း တပ္မဟာ (၃) KIA ေရွ႕တန္းစခန္းမွ ေျပာသည္။

ယခုခ်ိန္ KIA တပ္မဟာ (၃) ေအာက္ တပ္ရင္း (၁၂) ေဒသ သံတံတား၊ မုန္းဒိန္ပါ၊ မန္ကာ၊ ေကာင္ဂ်ာေဒသမ်ားတြင္ အစုိးရတပ္ စစ္အင္အား ၁၀၀၀ ေက်ာ္လႈပ္ရွားေနျပီး ယမန္ေန႔ မုန္းဒိန္ပါရြာသုိ႔လႈပ္ရွားလာေသာ အစိုးရတပ္သည္ တပ္မ ၉၉၊ တပ္မ ၈၈ တပ္ေပါင္းစုမ်ားျဖစ္ေၾကာင္း သိရသည္။

“စားေသာက္ဖို႔က သိပ္စိုးရိမ္စရာမရွိဘူး လယ္ေတြယာေတြရွိတဲ့ေနရာျဖစ္တယ္ အခုရွိေနတဲ့အစုိးရတပ္က ရြာသားေတြကို ဘယ္လိုထိန္းခ်ဳပ္ထားလဲဆိုတာကို စိုးရိမ္တယ္ ေဆြးေႏြးပြဲမွာ စစ္ရွိန္ေလွ်ာ့ခ်ေရးနဲ႔ တိုက္ပြဲေတြ ထပ္မံမျဖစ္ပြားရန္ သေဘာတူထားတယ္ ဒါမဲ့ သူတို႔ဘက္က လႈပ္ရွားလာျပီး တုိက္ပြဲေတြ ျဖစ္လာေတာ့ KIO ကို လက္မွတ္မထိုးတဲ့အတြက္ေၾကာင့္ ပစ္လို႔ရတယ္ဆိုတဲ့ သေဘာနဲ႔ ပစ္ေနတယ္လို႔ ျမင္တယ္” ဟု KIO ဒုကၡသည္ကယ္ဆယ္ေရး ေကာ္မတီဥကၠဌ ဆလန္ကဘာဒြဲပီဆာ KNG ကခ်င္သတင္းဌာနသို႔ ကသုံးသပ္သည္။

After several rounds of mortar shelling that also targeted an IDP camp and a boarding school in Mung Ding Pa village, Burmese army troops entered the village on Oct 22. Mung Ding Pa village, located in Mansi township in southern Kachin State, is a village of about 1000 villagers that include over 300 students in an IDP boarding school.

About 400 villagers who could not flee to safer areas are currently being held in a local church by government soldiers. A villager who had fled from Mung Ding Pa said, “Burmese soldiers occupy our houses in three blocks. The whole village is filled with Burmese soldiers.
