เมื่อวันที่ 3 ธันวาคม สภาทนายความได้ออกแถลงการณ์ เรื่องการปฏิบัติตน และการปฏิบัติหน้าที่ตามคำวินิจฉัยของศาลรัฐธรรมนูญ ดังนี้
ตามที่ปรากฏความชัดเจนแล้วว่ามีคณะบุคคล ข้าราชการทั้งฝ่ายบริหารและฝ่ายนิติบัญญัติ หัวหน้าพรรคการเมืองแสดงออกโดยชัดแจ้งถึงการไม่ยอมรับคำวินิจฉัยของศาลรัฐธรรมนูญนั้น สภาทนายความเห็นว่าเรื่องนี้เป็นเรื่องสำคัญอย่างยิ่งที่จะเผยแพร่ให้สาธารณชนทั่วไปทราบถึงข้อกฎหมายและการบังคับใช้คำวินิจฉัยของศาลรัฐธรรมนูญ ดังนี้
1.ผู้ที่มีหน้าที่และต้องปฏิบัติตามคำวินิจฉัยของศาลรัฐธรรมนูญนั้น มาตรา 216 วรรคห้า ของรัฐธรรมนูญแห่งราชอาณาจักรไทย ได้บัญญัติไว้อย่างชัดเจนว่า “คำวินิจฉัยของศาลรัฐธรรมนูญให้เป็นเด็ดขาด มีผลผูกพันรัฐสภา คณะรัฐมนตรี ศาล และองค์กรอื่นของรัฐ” ความชัดเจนของบทบัญญัตินี้จึงไม่อาจแปลความเป็นอย่างอื่นได้ว่าจะมีองค์กรใด บุคคลหรือคณะบุคคลใดที่จะสามารถปฏิเสธหลักการถ่วงดุลในระบอบประชาธิปไตยตามหลักสากล
2.หลักการถ่วงดุลนี้มีปรากฏตามพระบรมราชปณิธาน ที่ได้พระราชทานรัฐธรรมนูญไว้ มีความตอนหนึ่งอยู่ในวรรคสามว่า “การยึดถือระบอบประชาธิปไตยอันมีพระมหากษัตริย์ทรงเป็นประมุขเป็นวิถีทางในการปกครองประเทศการคุ้มครองสิทธิและเสรีภาพของประชาชน ให้ประชาชนมีบทบาทและมีส่วนร่วมในการปกครองและตรวจสอบการใช้อำนาจรัฐอย่างเป็นรูปธรรม การกำหนดกลไกสถาบันทางการเมืองทั้งฝ่ายนิติบัญญัติและฝ่ายบริหาร ให้มีดุลยภาพและประสิทธิภาพตามวิถีการปกครองแบบรัฐสภา รวมทั้งให้สถาบันศาลและองค์กรอิสระอื่นสามารถปฏิบัติหน้าที่ได้โดยสุจริตเที่ยงธรรม” จึงเป็นการวางหลักการถ่วงดุลอำนาจอธิปไตยทั้ง 3 ทาง ซึ่งพระมหากษัตริย์จะทรงใช้พระราชอำนาจตามรัฐธรรมนูญ Continue reading “Suthep Thaugsuban (สุเทพ เทือกสุบรรณ) :Council Statement-เมื่อวันที่ 3 ธันวาคม สภาทนายความได้ออกแถลงการณ์ เรื่องการปฏิบัติตน และการปฏิบัติหน้าที่ตามคำวินิจฉัยของศาลรัฐธรรมนูญ ดังนี้”

The Myawady-Mae Sot Friendship Bridge, on the border between Myanmar and Thailand, collected over Ks 25 million (US$ 25,000) border fees in November from daily commuters and tourists.
Myanmar nationals top the list with 54,929 visitors who paid Ks 25,800,700 for the border fees. The bridge has also received US$ 3,830 (Ks 3.7 million) from 383 third party visitors and Bt 25,730 (Ks 785,000) from 2,573 Thai visitors.
“There were more Thai visitors this summer. We receive between 60 to 100 Thai visitors daily. Most of the foreigners came only after the Myawady border checkpoint had been opened as an international gateway,” said a border official.
Nearly 2,000 Myanmar nationals commute daily across the bridge. A total of 578,821 Myanmar nationals have passed through border checkpoints from January to November, paying over Ks 272 million (US$ 277,000) for border fees while only 25,490 Thai visitors crossed the bridge for the same period and paid Bt 254,900 (Ks 7.7 million).
A total of 3,195 foreign visitors visited Myawady over the past 11 months and paid US$31,950 in border fees.
While Thai visitors came to visit the pagodas in Myawady and the special economic zone, the majority of Myanmar visitors were workers, vendors and shoppers.
Although there is only one bridge to cross over Thaungyin River from Myawady to Mae Sot, there are around 20 legal and illegal boat rides regularly crossing the river.
“We charge Bt 10 (Ks 305) for Thai visitors and US$10 (Ks 9,820) as fees to enter Myawady,” said the official.
Myanmar nationals with temporary border passes are charged Ks 300 (US$ 0.30) while those without the border passes have to pay Ks 1,000 (US$ 1) to cross the border checkpoint to visit Thailand.

A one-stop service centre for Myanmar migrant workers whose visas have expired will be set up in December according to the Ministry of Labor, Employment and Social Security.
The centres will open at the Myanmar embassy in Thailand, as well as in border towns such as Mai Sai (Tarchileik), Maesot (Myawaddy), Khttkhee, Mautaung, and Ranaung (Kawthaung).
“We are going to open one service centres in border areas like Tarchileik and Myawaddy,” said an unnamed official of the Ministry.
The Ministry of Labor, Employment and Social Security will issue a red passport instead of previous temporary passport for Myanmar migrant workers with expired visas. The workers need to come to the centres at the respective border areas with their I.D cards and other necessary papers.
There are over 30,000 Myanmar migrant workers whose visas have expired according to the Migrant Worker Right Network.
For the Myanmar workers to continue working in Thailand, an agreement has been made with Myanmar and Thailand. The agreement on opening one-stop service centres for the migrant workers was discussed at a Myanmar–Thai workers coordination meeting held in October.

The demonstrators were led by former Songkhla MP Thaworn Senniem.
The demonstrators tried to push their way into the compound of the national police office which was protected by concrete barriers and barbed wire.
They started negotiating with the police to enter the compound peacefully but waere denied. Brief confrontation broke out when the demonstrators trying to push in but was pushed off.
A negotiation was held. But as negotiation was on, demonstrators managed to remove the barriers and cut the barbed wire and walked into the compound with no resistance.
At the negotiation, Thaworn said demonstrators led by the People’s Committee for Democratic Reform (PCDR) demanded that the police probe into the violence and bring the culprits for trial in 7 days.
They also demanded that the police stop firing teargas into demonstrators and not to act against demonstrators at night time.
All demonstrators later in the afternoon left the office back to their base at Government Complex on Chaeng Wattana road.
The violence in Ramkhamhaeng on Saturday and Sunday left two students and two red-shirt supporters of the government dead, and 58 others injured in gunfire, small bomb explosions, and fire.

Professor Dr Winai Warangnukul, head of the Toxicology Centre of Ramathibodi hospital, said Wednesday that the centre had examined water samples and found traces of tear gas in the samples. However, he assured that the tear gas content was small and would not pose danger to the body.
Dr Winai noted that there was a misunderstanding that the tear gas was acidic and that the substance could be neutralized with water mixed with alkaline. He said that the best way to treat victims attacked by tear gas was to use clean water to wash their eyes or body exposed to the gas.
He also suggested the victims to dust off residue of tear gas from their bodies.
The water used against the protesters was not mixed with tear gas but the water caused the tear gas cloud to scatter covering wider areas.

So Thailand’s been in the news a lot lately. I don’t know anything about Thailand. What’s up?
You really don’t know anything? Then we’ll have to start at the beginning. Back in 1939…
Hold it. I don’t want a history lesson. What’s the news?
Oh right, the news. Well, protesters want the current prime minister, Yingluck Shinawatra, to step down, so they started holding demonstrations in late November. They tried to get into the prime minister’s office building and the police station in Bangkok. There were clashes with the police, who fired rubber bullets and tear gas to try and disperse them. Four people died and more than 200 were injured.
Wow. Why don’t they like Shinawatra? Hey, doesn’t that sort of sound like Sinatra?
I guess so. Shinawatra has been a controversial figure because her brother, former Prime Minister Thaksin Shinawatra, is a zillionaire who was accused of corruption and run out of the country after a coup in 2006. Some Thai residents think she is just a puppet for him. He lives in exile in Dubai, and they’ve accused her of being his proxy. There are even stories of him running government meetings by phone.
Two Sinatras? A coup?! Wow.
No, no Sinatras. Two Shinawatras.
Right.
Earlier this year, current Prime Minister Shinawatra’s party introduced an amnesty bill to the legislature which her opponents feared would allow Thaksin Shinawatra to come back to the country and resume power. So they began protesting in November.
Does anyone support the Shinawatras?
Yes. In fact, most of the Shinawatras supporters are rural Thai folks and in the past their demonstrations have been even larger. But they have not taken to the streets recently. The city residents in Bangkok mainly support the opposition Democratic party.
So how big were the protests?
About 100,000 people protested in Bangkok at the beginning of the rallies, on Nov. 24. The number has dwindled since then.
Is it dangerous?
Actually, it’s become a lot less dangerous in recent days. On Monday, Prime Minister Shinawatra ordered the police to allowed demonstrators into her office building and the police station if they wanted to. Many of them flooded onto the buildings’ lawns, celebrated and took selfies, but there were no violent clashes. Police handed out roses. The prime minister hopes the situation will continue to deescalate.
What do the protesters want? Can it happen?
They want the democratically-elected Shinawatra to hand over power to an unelected council, who will then choose the country’s new leaders. She’s not playing ball on that one. She told protesters she’d work with them to reach a peaceful end to protests, but would not be stepping down.
